Oklahoma Advances WC Reforms

Oklahoma state legislators are advancing SB 642 which would make changes to the Administrative Workers’ Compensation Act, such as allowing a general contractor to pay for the workers’ compensation insurance of a sub-contractor while still protecting a third-party claim that an employee of that sub-contractor may have.
The bill also increases the maximum weekly partial-permanent disability payments to injured workers from $360 to $375.
WC claims were long handled in the judicial system, requiring an employee injured on the job to sue their employer in court.
As of 2014, claims are handled by the Oklahoma Workers’ Compensation Commission, which is funded by fees from workers’ compensation insurance policies taken out by employers.
The commission adjudicates cases between an employer and employee if the two parties can’t agree on compensation. State workers filed more than 80,000 claims in 2022 and 2023. About 15,000 a year end up before the WCC.

A new study by Clara Analytics found that advanced analytical methods with AI can accurately identify potential fraud indicators just two weeks after a claim is filed, significantly earlier than traditional approaches.
Among the findings, the study said network analysis revealed important connections between attorneys and medical providers that traditional methods might miss.
The study also highlighted the importance of the “Sentinel Effect” — where the awareness of being monitored leads to improved behavior. Insurers known for effective fraud detection are less likely to be targeted, offering a preventive advantage that extends beyond direct cost savings.
