NC Donor Convicted of Bribery

  • For the second time, an insurance magnate donor and a consultant have been convicted for bribing the North Carolina Insurance Commissioner.
  • The two were convicted of bribery and conspiracy to commit wire fraud.
  • The two individuals were accused of trying to give $1.5 million to Insurance Commissioner Mike Causey’s campaign in exchange for preferable regulatory treatment.
  • Last year, Greg Lindberg, the owner of several insurance companies, was indicted for separate federal charges.

Zurich Posts 2023 Results

  • Zurich Insurance Group has achieved a record business operating profit, according to a letter sent to shareholders.
  • Zurich also received its highest-ever return on equity of 23.1%.
  • Zurich says its P&C business operating profit increased by $3,893 million in 2023, an increase of 7% over the previous year.
  • The positive P&C numbers are the result of increased insurance revenue and improved investment results.

Injured at Work; Motivation is Irrelevant

  • A New York Appellate Court rules that the shooting of a worker arose out of the workers employment, despite motivation.
  • Justin Timperio was working in a hospital when he was shot by a former employee. Timperio sued the hospital for negligence.
  • The hospital tried to have the case dismissed, saying the shooting was not the result of work-related differences.
  • The appellate court says that the injury occurred out of the course of employment and therefore, arose out of employment as well. The motivation behind the shooting is not enough to rebut the presumption.

NJ Realtors Benefit from Court Decision

  • Perhaps a portent of things to come, a New Jersey Court rules that sales people are independent contractors in terms of their relationships to insurance brokers.
  • This means that under New Jersey law, they are not subject to the Wage Payment Law.
  • This also means that the test to determine whether or not a sales person is an independent contractor or an employee (the ABC test) does not apply, if there is a written agreement in place.
  • If workers are classified as independent contractors, they are not entitled to protections or benefits, including workers’ compensation.
