NCCI Trends Report Shows Construction Leads Claims Declines

  • Construction claim frequency has been declining by more than all industries combined, according to the latest NCCI Industry Trends Report.
  • “While the frequency of claims across all industries has been declining for many years, the extent of the decline varies over time and by industry. Since 2015, Construction claim frequency has been declining by more than all industries combined, while other industries such as Transportation & Warehousing have seen a flatter trend,” the report said.
  • As well, total lost-time claim severity has been decreasing for all industries combined.

Georgia Rule Updates Effective This Month

  • Several rule updates by the Georgia State Board of Workers’ Compensation have gone into effect this month, lawyers at Drew Eckl Farnham noted in a blog post on Mondaq.
  • Effective as of July 1, these changes include clarifications, organizational edits, and substantive revisions aimed at improving consistency and transparency in the workers’ compensation process.
  • Under the new rules, attorneys may request fees on medical expenses in limited circumstances, even when income benefits are no longer being paid.
  • Another change creates a consistent timeline for objections in rehabilitation cases, aimed at clearing up confusion over how much time parties had to file objections related to rehab services.

Virginia Adds David Bayne as Deputy Commissioner

  • The Virginia Workers’ Compensation Commission said that David L. Bayne, Jr. was sworn in this week as a deputy commissioner.
  • Bayne will serve as an administrative law judge under the state’s WC act and hold evidentiary hearings at the agency’s Fairfax Regional Office.
  • Bayne has litigated Personal Injury and Workers’ Compensation claims throughout Virginia for 25 years and handled appeals before the Virginia Workers’ Compensation Commission and Virginia Court of Appeals.
