- A police officer is appealing a one-day suspension handed to him in connection with a workers’ comp claim.
- The officer was reportedly denied a workers’ comp claim he filed for mental health issues. Upon receiving a letter denying his claim, the officer, Alex Vazquez, confronted the police chief for not backing him up.
- In addition to the police chief saying Vazquez confronted him in a loud and accusing tone, Vazquez allegedly called another officer a “d*ck head.
- Vazquez’s mental health claim was partly tied to alleged racist behavior against him.
Injured Teacher Denied Work Comp Claim
- A Texas teacher who single-handedly saved her students is still suffering from injuries, she says.
- Elementary school teacher, Mercedes Salas, carried her students out the of her classroom during the deadly Uvalde, Texas shooting through a shattered window.
- Salas says she hit her knees on cinder blocks and cut her hands during the rescue.
- After undergoing prescribed physical therapy, her workers’ comp claim for follow up therapy was denied. The company that handles the district’s workers’ comp claims said there was no indication that there was permanent damage to her body.
School Employee Accused of Fraud
- A Texas school district employee is accused of faking a workers’ comp claim.
- Reportedly the employee, Yadira Montalvo, filed an accident report saying she had fallen while walking away from the building near the Curriculum office.
- Video showed that Montalvo faked the fall, tossing her glasses to add authenticity and then signaled for help.
- She was arrested after she allegedly filed a workers’ comp claim.
Employer Misclassifies Workers
- An employer misclassified workers as independent contractors, depriving them of wages.
- Reportedly, North Carolina, company Utility Resource Services misclassified workers while also not keeping up with payroll records.
- The company claimed because another contractor didn’t pay them, they could not pay their workers. This is a violation of Department of Labor wage regulations.
- In addition to not paying fair wages, misclassification of workers is also a common way to avoid paying accurate workers’ comp premiums.
