Texas Mulls Tele-Medical Improvement Exams

Texas is considering allowing treating doctors to perform maximum medical improvement examinations by telemedicine or telehealth.
The Texas Division of Workers’ Compensation’s proposed rules would revise the definitions of “telemedicine services” and “telehealth services” to include maximum medical improvement exams and evaluation of permanent impairment in cases where the injured worker has been examined by the treating doctor for the condition included in a claim at least once previously.
The change requires that the injured worker must consent to the remote exam and the condition qualifies as a minor injury, requiring no additional treatment and has not resulted in an impairment.

Canada’s Saskatchewan province is considering amendments to the Workers’ Compensation Act which if passed would mean presumptive cancer coverage would be available to wildland firefighters.
That follows legislation in March that provides coverage for firefighters for 22 types of cancer.
With this amendment that same coverage would be extended to wildland firefighters.
Additional amendments would provide voluntary coverage, subject to approval from the Workers’ Compensation Board to Saskatchewan employers who staff work outside of that western province.
